Ron Beal, president and CEO of Memphis, Tenn.-based Orgill, presented his views on hardware distribution during the President's Council meeting in Las Vegas. Here are the highlights.

The overview

"I've been at this a long time. One of the things that always impressed me is how simple distribution is to conceptualize, but how complex and how difficult it can be to actually execute. … It's pretty easy to understand why companies are not exactly standing in line to get in the business of distributing hardware products."

NEW ORLEANS — The recent marriage of Valspar and Ace Hardware Corp. was by far the most colorful product story at Ace's Spring Convention and Exhibits held here.

Not only were dealers eager to see Ace's paint department vision of the future, they were hungry for details on the incentives in place to retrofit their stores.

Las Vegas — In the not-too-distant future, 84 Lumber sees itself giving its potential customers two bids — one regular bid, and one bid consisting exclusively of American-made products.

When it happens, builders may be surprised at the similarity in total costs, according to Jeff Nobers, VP marketing for the Eighty Four, Pa.-based pro dealer.

The all-American bid system is one of the ideas stemming from 84 Lumber's new initiative to encourage builders and consumers to buy American when building — called "We Build American."

Family and Medical Leave Act (FMLA) compliance is difficult and annoying, said Mark Oberti, an attorney with Oberti Sullivan LLP in Houston, at the National Employment Law Institute’s Annual Employment Law Conference in Arlington, Va., Nov. 16, 2012.

The U.S. Department of Labor’s FMLA regulations often aren’t much help, as they rarely make it clear when an employer may fire someone, he added.

Oberti outlined 12 compliance strategies for employers:

Most employers are reluctant to talk about unions and haven’t done it.

They should switch gears, however, and start encouraging supervisors to discuss unions to prevent their workforces from becoming unionized, as long as supervisors are trained on what they should and should not say, said Robert Brody, an attorney with Brody and Associates in New York and Westport, Conn., in a Nov. 8, 2012, firm webcast.
